General Terms and Conditions

1. Basic provisions

These general terms and conditions apply to orders for services of the SKI Zadov ski and snowboard school arranged by phone, online or purchased directly at the premises (hereinafter referred to as "General Terms and Conditions").

The operator of the SKI Zadov Ski School (hereinafter referred to as "SKI Zadov Ski School") is the company Czech cycling & ski s.r.o., Zdíkov 330, 384 73, ID No.: 28066090

Unless expressly agreed otherwise, these General Terms and Conditions apply to all legal transactions and contractual relations concluded online, by telephone and at the place of business between the operator SKI Zadov Ski School as a service provider and its clients as contractual partners - customers of services (hereinafter referred to as "clients").

Orders for the services of SKI Zadov Ski School can be made either via order forms at www.zadov.cz, www.skikvilda.cz www.sportsumava.cz, or via e-mail at kobyla@zadov.cz or by phone at +420734433386. The services of the SKI Zadov Ski School can also be purchased directly at any of the school's premises (Zadov - Kobyla, Zadov - U Horejšů, Kvilda).

2. Services offered by SKI Zadov Ski School

All offers of the SKI Zadov Ski School presented in the shops or online may have a limited validity. Prices are presented in CZK including all taxes.

SKI Zadov Ski School does not assume any guarantee for the timeliness, correctness, completeness or quality of the information provided. Liability claims made against SKI Zadov Ski School for any damage of a material or immaterial nature caused by the use or non-use of the information provided, or by the use of incorrect or incomplete information, are excluded in principle, unless SKI Zadov Ski School is proven to be grossly at fault.

The SKI Zadov Ski School expressly reserves the right to change, supplement or delete parts of the website or the entire offer or to temporarily or definitively discontinue the presentation without special notice.

3. Conclusion of the contract

3a) Telephone and online booking of services, order confirmation, conclusion of the contract

Only written order confirmations from SKI Zadov Ski School are decisive for the acceptance of a telephone or online reservation and the scope of the service provided. The written confirmation of the order by Ski Zadov Ski School is the conclusion of the contract. Secondary verbal or telephone arrangements are only valid in the case of an explicit written confirmation by SKI Zadov Ski School.

Ski Zadov Ski School undertakes to respond promptly to written or electronic correspondence from the client, if possible within three working days at the latest.

3b) Conclusion of the contract at the premises

In the case of the purchase of the services of the Ski School SKI Zadov according to its current offer

 services at the premises of the school, a contract is concluded between the operator and the client at the premises.

4. Payment terms

4a) Payment terms for the purchase of services by telephone and online

If no other arrangements have been made, the following shall apply

 made electronically or by telephone immediately upon receipt of written confirmation of the order, to pay in advance the full price of the service. 100% payment in advance is therefore required.

In the event of delay in payment, the SKI Zadov Ski School is entitled to charge the client statutory interest on late payment or to withdraw from the contract. Withdrawal from the contract is made by the Ski School SKI Zadov in writing, (delivery of the withdrawal by e-mail is also considered as delivery).

SKI Zadov Ski School reserves the right to unilaterally change prices depending on the quality or change of the ordered range.

By paying the price of the service, the client agrees to the General Terms and Conditions.

4b) Payment conditions for the purchase of services in the shop

When purchasing services in the shop, the client pays the price of the services of SKI Zadov Ski School on the spot. Therefore, 100% payment in advance is required. The operator will issue a tax receipt to the client on the spot.

In the event of delay in payment, SKI Zadov Ski School is entitled to charge the client statutory interest on late payment or withdraw from the contract. Withdrawal from the contract is made by the SKI Zadov Ski School in writing (delivery of the withdrawal by e-mail is also considered as delivery).

The SKI Zadov Ski School reserves the right to unilaterally change prices depending on the quality or change of the ordered range.

By paying the price of the service, the client agrees to the General Terms and Conditions.

5. Scope of services and claims

Ski and snowboard lessons are provided daily in all weather conditions by certified instructors. The lesson lasts 50 minutes. Lessons are at your own risk and the Seller recommends that you take out accident insurance prior to the lesson. The client is obliged to truthfully inform the instructor of his/her skiing and snowboarding abilities and experience and, if applicable, any health problems that may arise during the sport prior to the start of the lesson. The client must strictly and consistently respect and follow the instructions of the SKI Zadov Ski School instructor. Failure to follow instructions and warnings entitles the SKI Zadov Ski School instructors to terminate the contract immediately.

SKI Zadov Ski School reserves the right to immediately terminate the contract with a client who is under the influence of alcohol and/or other addictive substances, as well as with a client who physically or verbally attacks the instructor. In the event of termination of the contract in such cases, the client is not entitled to reimbursement of the costs incurred for the service or any compensation.

The ski or snowboard instruction service will be provided at a pre-arranged location and time. A change of place or time can only be made after both parties have agreed. In the event that the client fails to arrive at the destination at the pre-arranged time, he/she shall not be entitled to compensation for the service so missed. The instructor will wait for the client for a maximum of 20 minutes from the agreed start of the service.

6. Cancellation Policy

The client is entitled to withdraw from the contract at any time before delivery of the service - cancellation conditions. The client does not have to state the reason for which he/she withdraws from the contract.

In case of cancellation of the service:

more than 14 days before the start of the service, 100% of the amount paid will be refunded.

12 - 13 days before the start of the service 80% of the amount paid will be refunded

11 - 8 days before the start of the service, 60% of the amount paid will be refunded

5 - 7 days before the start of the service 40% of the amount paid will be refunded

2 - 4 days before the start of the service 20% of the amount paid will be refunded

In the event of cancellation less than 24 hours before the start of the service or failure of the service due to reasons on the client's side, the client is not entitled to a refund of the amount paid.

7. Processing and storage of personal data

The scope of personal data processed is minimized to the extent necessary for the purpose of recording and identifying the client.

All necessary information required for the processing of personal data is made available in the Personal Data Processing Policy at www.tmr.sk.

8. Effectiveness

These General Terms and Conditions are effective from 1 November 2021.

Should individual provisions of these General Terms and Conditions be or become ineffective, this will not affect the effectiveness of the other provisions or the entire legal transaction. The ineffective provision shall be replaced by a provision that most closely corresponds to the purpose of the ineffective provision. Any amendments to these General Terms and Conditions must be made in writing. SKI Zadov Ski School is entitled to change the General Terms and Conditions unilaterally.

9. Payment

Credit card payments in favor of the Ski School will be collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement. The domain where you enter and process your payment is owned and operated by TREKKSOFT.
